Abstract
If anyone is possessed of an ambition to fill up ‘gaps’ in the Constitution by restoring safeguards to the people, (they) may start by endeavouring to secure that the right of trial by jury in serious cases should be made effective, for, as it is, s 80 means little more than this ‘if an offence against Commonwealth law is triable before a Superior Court and a jury and if it is so tried, then it shall be so tried’.
