Anencephalic Newborns as Organ Donors: Legal and Ethical Issues

Abstract

Despite the apparent benefits, the issue of anencephalic organ donation has been the centre of considerable controversy. The questions raised are not primarily medical in nature, but rather they revolve around fundamental ethical, legal, political and philosophical debates about the definition of death, the justification of non-therapeutic intervention, candidacy for organ transplantation, and putting society on what has been called the 'slippery slope'. In this review, some of the medical, legal and ethical issues of using anencephalic infants as organ donors will be outlined and evaluated.
